How does privilege review automation work?

Privilege review is one of the slowest and highest-risk stages of document review. Automation does not remove the lawyer's judgment from it - it narrows what a lawyer has to look at and makes the process more consistent.

Most automated privilege workflows combine several layers:

Counsel and law firm name lists. Building a list of internal and external legal names, then matching it against sender, recipient, and body text, isolates the population most likely to contain privileged material.

Search terms and metadata rules. Terms like "legal advice" or "privileged and confidential", combined with domain matching and date ranges, catch the obvious candidates. These rules are cheap to run but produce false positives, so they work best as a first pass rather than a final answer.

AI classification. Machine learning and generative AI models can score documents on whether they appear to reflect legal advice, and can explain why a document was flagged. This helps rank a review queue so the most likely privileged documents surface first.

Privilege log support. Once documents are coded, the metadata and reasoning captured during review can be assembled into draft privilege log entries, which is usually a heavy manual task.

The important limit: privilege is a legal determination that depends on jurisdiction, the relationship between the parties, and the purpose of the communication. Automation is best treated as a prioritization and consistency tool, paired with a documented process and quality control sampling so the calls can be defended if they are later challenged.
